Disclaimer and Limitation of Liability as to Products Sold at us.ooka.com

All of us.ooka.com's products are guaranteed against defects for one year from the date of shipment under the limited warranty. By ordering from us.ooka.com, you agree and certify under penalty of perjury and as per State and Federal guidelines that you are at least 21 years of age or older, and able to purchase tobacco and/or tobacco-related products and/or tobacco accessories in your state and locality.

By ordering from us.ooka.com, you also agree that us.ooka.com has up to 14 business days to ship your merchandise out of our facilities. Once an order has been shipped and/or tracking information has been received and provided from the shipping carrier, a customer cannot cancel and/or refuse delivery of their order without prior consent from us.ooka.com via email or US Mail. us.ooka.com reserves the right to charge a twenty-five (25%) percent restocking fee on any order returned to our company after final inspections. us.ooka.com also reserves the right to charge any applicable fees that may have been associated with the order at the time of shipping if merchandise is returned to our facilities. Any merchandise returned to our facilities must be unused and in all original packaging. Any merchandise deemed used will be refused by us.ooka.com and will be returned to the customer at the customer's expense. If a Return Merchandise Authorization (RMA) was issued by us.ooka.com, the customer is responsible for paying the return fees associated with the shipping carrier’s standard rates guide if the merchandise is deemed used, not in its original condition, or is returned because the customer was not satisfied with the merchandise and us.ooka.com has concluded that there is nothing wrong with the merchandise received back in our facilities.

You agree that the sole and exclusive maximum liability to us.ooka.com arising from any product sold on the us.ooka.com site shall be the price of the product ordered. In no event shall us.ooka.com, its directors, officers, employees, or other representatives be liable for special, indirect, consequential, or punitive damages related to products sold.

us.ooka.com currently accepts the following payment methods: Credit/Debit Card via Visa, MasterCard, American Express & Discover. In the event of a chargeback or non-payment against us.ooka.com through our consumer or business channels, the account holder will be responsible for all fees regarding collections. These fees include but are not limited to, the North Carolina Service charge, the $50 chargeback fee issued by the credit/debit card issuer, all applicable collection agency fees incurred by us.ooka.com, any or all attorney fees, and legal costs incurred, original shipping charges incurred by us.ooka.com and return shipping charges incurred by us.ooka.com. In the event of non-payment, the customer will be responsible for the costs of the merchandise at the time of order.

All tobacco and tobacco-related products and accessories sold at us.ooka.com are intended for legal tobacco smoking use by adults (21 years or older) only. Any other use of such products, by minors or for use with controlled substances is prohibited by and may constitute a violation of International, Federal, State, and/or Local Laws.

By entering the site, you: (1) agree to us.ooka.com Terms of Service; (2) verify you are at least 21 years of age; (3) verify that tobacco products, and smoking accessories are sold legally in your city, county, state, and country; (4) agree to use the products offered herein for legal and intended uses only; (5) verify you are not visiting with any malice towards us.ooka.com; (6) by entering this site you are observing any and all local laws and (7) irrevocably waive any and all liability resulting from the purchase and/or use of such products. Typographical Errors

In the event a product is listed at an incorrect price or with incorrect information due to typographical error or error in pricing or product information received from our suppliers, us.ooka.com shall have the exclusive right to refuse or cancel any orders placed for products listed at the incorrect price. us.ooka.com shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, us.ooka.com shall issue a credit to your credit card account in the amount of the charge. Be aware that based on your agreement with your card issuer the charge may take several days or more to be credited back to your account and the funds otherwise released to you.

Age Verification and Credit Card Fraud Review:

Age Verification

We do not sell products to persons under the legal age for tobacco purchases within their respective jurisdictions. To verify your age, we use a non-affiliated third-party company, Veratad Technologies, LLC, to confirm that the information you provided upon checkout is accurate and that you meet the legal age requirement to order from our website.

How does Veratad work?

Veratad Age Verification services employ multiple trusted data sources that contain billions of public records that assist in providing age validation based on the personal information you have submitted to us. We only use this service to attempt to verify your age and identity while keeping your information completely safe from distribution. Veratad uses secure 256- bit encryption technology to ensure the safe delivery of the information you provide online. Veratad does not save or store sensitive personal information, nor will it be shared or sold to third parties.

What if Veratad cannot confirm my age?

Some shoppers may not be able to have their age confirmed based on a Veratad search alone. Your public record data may be limited or simply too outdated for Veratad to confirm that your personal information is accurate. If this happens, we will reach out to you via email and phone to manually verify your age. We typically require you to provide a photo of yourself holding a valid state-issued ID card to confirm both your identity and age.

Once age verification is completed, we will update our system so you will not be subjected to the same process on future orders. None of the information you provide via email will be saved in our database or shared with outside parties, and any age verification emails containing your sensitive information can be deleted permanently upon your request.

We understand that a pre-authorization has already been captured as payment for your order, which is why orders awaiting age verification are contacted daily using the email address and phone number submitted online until we either confirm your age or cancel the order. Please note that funds can easily be released back to you if age verification cannot be completed. Only after an order ships, will we collect the final payment for your order.

Credit Card Review

At us.ooka.com, we take the threat of credit card fraud very seriously. We use an internal fraud score algorithm that evaluates every order based on the billing information you provided on our website, the shipping information provided, the credit card information entered, and the order size (in dollars). Any orders that receive a high fraud score will be subjected to credit card fraud evaluation. In addition to our algorithm, we have a team of professionals who review and process orders, and they have a license to initiate fraud reviews based on their autonomous evaluations.

What is required of the credit card review?

Much like the age verification process, credit card reviews can be permanently completed in one email. We typically require you to send a photo of the cardholder, holding his/her credit card and state-issued ID card or passport so we can confirm the credit card number and identity of the cardholder all at once. We only require the last 4 digits of the credit card to be visible in the picture, as well as the name on the card and ID card or passport to confirm that they are a match. None of the information you provide via email will be saved or shared with outside parties, and we will delete any email containing sensitive information upon your request.

If the image you provide is acceptable for verification, your order will then be processed, and the credit card used for the order will be permanently verified for future orders.
However, we reserve the right to re-open fraud evaluation at any time upon detecting potentially fraudulent activity.

Under Federal guidelines, hookah smoking is considered to be legal in all 50 states of the United States of America. United States Code, Title 21, Section 863, which is titled the "Controlled Substance Act" permits hookahs to be purchased and used for legal smoking and cultural practices that follow local, state, and federal guidelines.

 

Order Accuracy

It is very important that when you place your order with us.ooka.com you understand that you and only you are responsible for the accuracy of the items and quantity you select as well as your personal and payment information. Prior to submitting your order, be it through our website or by telephone, please be sure to completely verify the accuracy of all information regarding your order items, quantity, applicable promotions, shipping and billing information, and your payment method with your customer representative if you are placing the order by telephone or on the checkout page of the website if your order is being placed online. Promotions and Offers

Throughout the year, us.ooka.com may offer various promotional items, discounts, gift cards, or incentive codes (collectively promotion(s)) on our website and throughout our social media channels. Each promotion, be it a monetary discount or a redeemable physical item, is governed by strict qualifying terms. If you fail to meet the requirements of these terms you shall not be able to redeem the promotional item. Please understand that only (1) one promotion may be redeemable during (1) order. You may not combine promotions. Prior to completing the checkout process and submitting your order, it is your responsibility to properly identify and select the promotion you qualify for by adding it during the checkout process. In the event you submit your order and have failed to add a qualifying promotion, please contact our Customer Service Team immediately by phone at 1-888-866-5232, Monday through Friday, from 10 AM through 6 PM EST. In the event, that we, in our sole discretion, agree to honor the promotion and it involves complementary physical merchandise, the customer shall be responsible for all applicable shipping charges associated with the shipping of this promotional item if we are unable to combine it with the current qualifying order placed.

Taxes

Each customer shall be solely responsible for all sales taxes, tobacco taxes, or other taxes, on orders shipped unless reflected in the order.

 

Order Cancellation Policy

us.ooka.com's goal is to provide the fastest possible service to its customers. To accomplish this goal, your order will begin to be processed shortly after it is received. We currently cannot guarantee that we will be able to cancel your order once we have commenced charging and submitting it for processing. If your order has not already been charged with your approved method of payment as placed with your order, we should easily be able to cancel it; however, once your order has been charged it is being fulfilled and shipped, and we will not be able to cancel your order at that time.

We strongly recommend that all customers wishing to cancel an order do so within 60 minutes from the time your original order is placed during our normal business hours Monday-Friday 10:00 am - 6:00 pm EST by contacting our Customer Service Team at 1-888- 866-5232. In the event you have submitted your order outside of our normal business hours then please submit an online support ticket.

In the event that we are unable to cancel your order and you are interested in returning your OOKA merchandise, you may return it in original and unused condition for a full refund of the purchase price. The return must be shipped within 30 days from the time your merchandise is shipped to you by the designated shipping carrier. Shipping charges and any applicable restocking fees are not refundable.

 

Domestic Return Policy

If you would like to return your unopened/unused OOKA to us.ooka.com, you must submit an electronic inquiry or phone call to initiate the return, and the return must be shipped within 30 days from the time your merchandise is shipped to you by the designated shipping carrier.

We do not accept returns of the consumable pods at this time unless damaged or defective. us.ooka.com reserves the exclusive right in its absolute discretion to determine whether the merchandise is defective or damaged.

 

Claims Procedures for Incomplete or Incorrect Merchandise

“What do I do if my order is incomplete or incorrect?”

Please be advised that we take every precaution in making sure that your order arrives in acceptable condition. If your order is incomplete, or incorrect please submit an electronic inquiry via our Contact Us page within 30 days of the shipping date of the order. Once a support request is established with our Customer Service Team, we will help you throughout the claims process to effectively coordinate the information we require to achieve the resolution of your inquiry.

Please understand that incomplete or incorrect claims do take time to process with the applicable shipping carrier and we appreciate your patience and ongoing cooperation during this process. Please understand that merely submitting a support request regarding incomplete or incorrect merchandise is only the first step and that we do require your continued cooperation throughout the claims process. Without your continued cooperation, your claim may be closed and otherwise denied for any unreasonable delay, lack of activity, or responsiveness on your part. Do not ship your incomplete or incorrect item back to our facility at any time as we do have a clear procedure to follow, and we shall not be responsible for any loss, or further damage caused by doing so.

 

Claims Procedures for Defective or Damaged Merchandise

“What do I do if my order contains defective or damaged merchandise?”

All of us.ooka.com's products are guaranteed against defects for one year from the date of shipment under the limited warranty. Failure to report defective merchandise within the referenced timeframe may result in your claim being denied. us.ooka.com prides itself on its ability to effectively perform quality control checks on all merchandise it manufactures or otherwise receives from third-party manufacturers to detect and eliminate defective or damaged merchandise from being passed on to its customers. While we take every reasonable step to detect and eliminate defective or damaged merchandise from the us.ooka.com inventory, in the unfortunate situation that your order contains merchandise that you feel to be defective or damaged, please immediately submit an electronic inquiry via our Contact Us page. us.ooka.com reserves the right at its sole discretion to either remedy, repair or replace the defective merchandise. Please understand that damage claims do take time to process with the applicable shipping carrier and we appreciate your patience and ongoing cooperation during this process.

us.ooka.com is not responsible for honoring return or reshipping charges associated with a defective or damaged merchandise claim unless we pre-approve the same in writing and provide a return shipping label to you. Please do not merely ship back the merchandise but permit our experienced Customer Service Team to guide you through the process of determining if a replacement is necessary to remedy the situation. Please understand that merely submitting a support request regarding what you believe to be defective merchandise is only the first step. We require your continued cooperation throughout the claims process to determine if the merchandise you received is defective. Without your continued cooperation, your claim may be closed and otherwise denied for any unreasonable delay, lack of activity, or responsiveness on your part.

 

“What do I do with merchandise being claimed as defective or damaged once my claim has been submitted?”

During the claims process for merchandise being claimed to be defective or damaged, all merchandise that is the subject of a claim must be retained by you until we notify you otherwise. Do not discard any merchandise being claimed as defective or damaged. us.ooka.com may seek the return of the merchandise you claim as being defective or damaged to our facility for further inspection and testing. Prematurely discarding merchandise that is being claimed as defective or damaged will result in the immediate denial of your claim. Once the claims process is complete, we will expressly provide you with confirmation that the merchandise at issue may now be discarded. All applicable shipping charges for returning the item to our facility shall be the responsibility of the customer unless, at our sole discretion, we provide you with a prepaid return label at our expense.

 

Disputes, Jurisdiction, and Venue

By placing an order with us.ooka.com, the customer hereby consents to the following terms of service regarding disputes. Any dispute, controversy, or claim arising out of or relating to the us.ooka.com Terms of Service, or the breach thereof (Dispute), shall be settled by binding arbitration, conducted on a confidential basis, under the then-current Commercial Arbitration Rules of the American Arbitration Association (the Association) strictly in accordance with the terms of this Agreement and the substantive law of the State of North Carolina. The arbitration shall be held at a mutually agreeable location in Charlotte, Mecklenburg County, North Carolina, and conducted by one arbitrator chosen from a list of attorneys who are members of the Association commercial arbitration panel, who is knowledgeable about the subject matter forming the basis for the Dispute and who has been engaged in the practice of law for at least ten (10) years. If the parties cannot promptly, within (30) thirty days, agree on the selection of the arbitrator, the arbitrator will be chosen pursuant to Rule of the Commercial Arbitration Rules of the Association. The initial costs of the arbitration, including initial fees to be paid to the arbitrator, shall be initially shared equally by the parties to the Dispute. Each party shall bear the cost of preparing and presenting its case to the arbitrator; however, in any dispute brought by either party against the other party to enforce such party's rights or remedies under this Agreement, the prevailing party shall be entitled to be reimbursed by the other party for the prevailing party's reasonable attorney’s fees, Arbitration costs, and expenses otherwise incurred in pursuing and prosecuting such Dispute. The arbitrator shall issue his/her award and a brief description of the basis for the award in writing. The judgment upon the award rendered by the arbitrator may be entered and enforced in any court of competent jurisdiction. Neither party shall be precluded hereby from seeking provisional remedies in the courts of any jurisdiction including, but not limited to, temporary restraining orders and preliminary injunctions, to protect its rights and interests, but such shall not be sought to avoid or stay arbitration. The parties agree that they have voluntarily agreed to arbitrate their disputes in accordance with the foregoing. The parties also agree that their dispute, the arbitration process, any evidence disclosed and or otherwise obtained during the same as well as the final judgment/decree by the arbitrator shall be confidential, the disclosure of which shall be actionable by either party should a breach of the same ensue.

 

Order Acceptance Policy

Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. us.ooka.com reserves the right at any time after receipt of your order to accept or decline your order for any reason. us.ooka.com reserves the right at any time after receipt of your order, without prior notice to you, to supply any item less than the quantity you ordered of any item. All orders placed over $250.00 (U.S.) must obtain pre-approval with an acceptable method of payment, as established by our credit and fraud avoidance department. We may require additional verification or information before accepting any order.

 

Service and Support
